The short version

You are buying a licence to use digital files, not ownership of them.
You can use them on stores you own or operate. You cannot resell, share or re-publish them.
Your access code is for you only. Sharing it can cancel your access.
We do not promise sales or ad results. The files are tools, and results depend on your product, offer and ads.
Refunds are covered in our Refund Policy.

1. About these terms

These Terms of Service ("Terms") are an agreement between you and Ecomlab, operator of ecomlab.in ("Ecomlab", "we", "us"). By visiting the website or buying a product, you accept these Terms, our Refund Policy and our Privacy Policy. If you do not agree, please do not buy or use the website. You must be at least 18 years old, or buying with the involvement of a parent or guardian, and able to enter into a binding contract under Indian law.

2. What we sell

We sell digital products, mainly access to a library of Shopify themes, components and related files, as described on the product page at the time you buy. The product page is the description of what you are buying. We may improve, add, replace or remove files over time. We do not promise any particular future update unless we say so in writing on the product page.

3. Ordering, price and payment

Prices are shown in Indian rupees (INR) and include applicable taxes unless the checkout says otherwise.
Payment is taken at checkout through Shopify and our payment provider (Razorpay). We do not see or store your full card, UPI or bank details.
An order is accepted when payment succeeds and we deliver access. We may cancel and refund an order if we suspect fraud, if the price shown was an obvious error, or if we cannot deliver.
Please give a correct email address and phone number at checkout. We deliver to that email.

4. Delivery

After payment succeeds, we send an email to the address you used at checkout with a library link and an access code. This normally arrives within a few minutes. If it does not arrive within 24 hours (check spam and promotions folders first), email us at atif29560@gmail.com with your order number and we will re-send or reissue it. Delivery is complete when the email is sent to the address you gave us.

5. Your licence

When you buy, we give you a personal, non-exclusive, non-transferable, non-sublicensable licence to download and use the files for as long as you comply with these Terms, as follows.

You may:

use the files on Shopify stores that you own or operate, and modify them for those stores;
keep a backup copy for your own use.

You may not:

resell, rent, share, gift, sublicense, upload or otherwise distribute the files, the library or any part of it, whether modified or not, including on marketplaces, Telegram, WhatsApp, Discord, torrent or file-sharing sites;
give your access code or library link to anyone else, or use another person's;
use the files to build a competing library, template pack or product for sale;
use the files on a store you build for someone else, or hand the files to a client, without our prior written permission;
remove licence notices or copyright notices from the files, or claim the files as your own work;
bypass, test, attack or interfere with the access lock, or scrape the library website.

If you break these rules, we may cancel your access without a refund, and we may take legal action.

6. Third-party components

Some files include or build on open-source or third-party code. Each such component stays under its own licence, which is stated in the files or the notices that come with them. Nothing in these Terms changes those licences. If a third-party licence gives you more rights for that component than these Terms do, that licence applies to that component only.

7. Our intellectual property

Apart from third-party components, we own or are licensed to use all content in the library and on the website, including designs, code, text and images. You get only the licence in Section 5, and no other rights are transferred to you. "Shopify" is a trademark of Shopify Inc. Ecomlab is an independent business and is not affiliated with, endorsed by or sponsored by Shopify.

If you believe something in the library or on our website infringes your rights, email atif29560@gmail.com with the details and proof of ownership, and we will review it promptly.

8. Access code and account security

Your access code is personal to you. You are responsible for keeping it safe and for anything done with it. If you think someone else has your code, tell us so we can replace it. We may cancel or limit access if the code is shared, used in an unusual way, or linked to a refunded or charged-back order.

9. Compatibility and no promise of results

The files are built for Shopify's Online Store and may depend on your Shopify plan, theme, apps and settings. We do not promise that they will work with every store, app, browser or future version of Shopify. We do not promise any level of sales, conversion, profit or advertising results. Any examples or numbers on our website illustrate what the product does and are not a guarantee of what you will earn.

10. Support

We provide help with access and with problems in the files as delivered, by email, within a reasonable time. Support does not include building, customising or running your store, writing ads, or fixing problems caused by your own changes or by third-party apps.

11. Refunds

Because our products are digital and delivered instantly, refunds are limited to the cases in our Refund Policy. This does not affect any right you have under law that cannot be excluded.

12. Warranty disclaimer and limit of liability

We work to make the files accurate and usable. To the extent allowed by law, the files and the website are provided "as is" and "as available", without promises beyond those in these Terms and on the product page. To the extent allowed by law, we are not responsible for indirect or consequential loss, such as lost profit, lost sales, lost data or business interruption, and our total liability to you for any claim about a product is limited to the amount you paid for that product. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including your rights as a consumer under the Consumer Protection Act, 2019.

13. Your responsibilities

You are responsible for your own store, products, ads, pricing, taxes, customer support and legal compliance, including consumer, advertising and data-protection law in the places you sell. You agree to compensate us for loss we suffer because you broke these Terms, for example by distributing the files.

14. Privacy

We handle personal information as described in our Privacy Policy. We use your details to process your order, deliver and secure your access, give support, meet legal duties and, where you agree or the law allows, tell you about our products. We use cookies and similar tools, including advertising pixels, to measure and improve our website and advertising. Where required, we ask for your consent first.

15. Changes

We may update these Terms. The version that applies to your purchase is the one on this page when you bought. For later changes, the new version applies to new purchases and, for existing customers, from the date posted, unless the change takes away a right you already paid for, in which case we will tell you first.

16. Ending access

You can stop using the product at any time. We may end your access for a serious breach of these Terms, with notice by email where we reasonably can. If we ever decide to stop offering the library, we will give reasonable notice by email to buyers so you can download what you need.

17. Governing law and disputes

These Terms are governed by the laws of India. We hope to settle any dispute by talking first, so please contact us before starting formal proceedings. As a consumer you may bring a complaint before the Consumer Commission that has jurisdiction over you, as the law allows. For any other dispute, the courts of Bengaluru, Karnataka have jurisdiction.

18. Grievance Officer

In line with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, you can raise complaints with our Grievance Officer:

We acknowledge complaints within 48 hours and aim to resolve them within one month of receiving them.

19. General

If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms to anyone else. These Terms, the Refund Policy and the Privacy Policy are the whole agreement between us about your purchase.
